General Terms and Conditions
1. Service Description:
Pixeneering offers professional video tutorials in technical fields. Our services include on-site filming, video editing, and the creation of video files. These video tutorials serve as a means of knowledge exchange within a company to effectively store and convey technical know-how.
2. Price Structures:
Our price structure includes travel costs, filming costs, and editing costs. Travel costs vary depending on the distance to the filming location. Filming costs are €99 per hour, and editing costs are €199 per minute of the finished video. If a video does not end exactly at the full minute, billing will be done in 15-second increments at €49 each.
3. Limitation of Liability:
Pixeneering is not liable for the information in the video. The videos created by Pixeneering are tools and are not a substitute for operating instructions. The customer is solely responsible for the accuracy of the information in the video. Our liability is limited to the amount paid by the customer for our services.
4. Changes to the Terms and Conditions:
Pixeneering reserves the right to amend these General Terms and Conditions (GTC) to a reasonable extent. Customers will be informed of such changes in a timely manner and will have the opportunity to terminate the contract if they do not agree to the amended terms.
5. Intellectual Property and Copyrights:
Pixeneering retains all intellectual property rights, including copyrights, to the video materials created by us. Customers may use the videos exclusively in accordance with the agreed-upon terms.
6. Termination of Work Due to Inappropriate Behavior:
Pixeneering reserves the right to terminate video shooting at any time and without prior notice if inappropriate behavior by the customer's employees is observed during the shoot. Inappropriate behavior includes bullying, racism, sexual harassment, or any actions that jeopardize the safety, quality of work, or well-being of others.
7. Orders:
Our services are provided on a project basis, without long-term contracts or minimum terms. Collaboration begins with the acceptance of an order and ends upon completion of the agreed-upon work, unless otherwise specified.
8. Consent to the Use of Image and Audio Recordings of Persons:
If individuals from the customer's company appear and are identifiable in the created video tutorials, the customer must ensure that they have obtained the express written consent of these individuals for the use of their image and audio recordings in the videos. Pixeneering assumes no responsibility for obtaining these consents and is not liable for claims from individuals who appear unintentionally in the videos and have not given written consent for the use of their recordings.
9. Price Deviation Due to Customer Information:
We are happy to offer our customers customized quotes for our services. However, it is important to note that the actual price of a video tutorial may depend on the information provided in your order and the accuracy of the information provided. We strive to make our quotes as accurate as possible, but if requirements or circumstances change during the project, or if the initial information was incomplete or inaccurate, this can lead to price deviations. We will inform you in such cases in a timely manner of any price changes and ensure that you have the opportunity to approve the changes before proceeding.
10. Deletion of Videos:
Videos created by Pixeneering and delivered will be automatically deleted within 14 days after payment. Please note that Pixeneering is not responsible for the long-term storage of your data.
11. Organization of the Filming Day:
The organization of the filming day is done to the best of Pixeneering's knowledge and ability. Additional costs due to organizational errors on the part of the customer that require rescheduling or repeating the filming day will be borne by the customer.
12. Payment Terms:
The payment term for our services is 45 days after invoicing. Please note that we reserve the right to take legal action if payments are not made in a timely manner.
13. Equipment Damage:
The customer is obliged to handle the provided equipment with care. In case of damage caused by the customer, additional costs may be incurred to restore or replace the equipment.
14. Prohibited Distribution of Videos:
The distribution of videos created by Pixeneering to third parties without prior written permission is strictly prohibited.
15. Confidentiality:
Pixeneering commits to treating all information disclosed during collaboration with the customer as confidential and not disclosing it to third parties.
16. Security and Data Loss:
Pixeneering makes reasonable efforts to ensure the security of all video files and information. However, no absolute security can be guaranteed, especially in relation to cyberattacks or physical theft of storage media. In the event of data loss due to cyberattacks, theft, or other unforeseen circumstances, Pixeneering is not liable for damages or losses incurred.
17. Customer Right of Withdrawal:
Customers have the right to withdraw from a closed contract free of charge. This right of withdrawal must be exercised in writing and communicated no later than 14 days before the planned filming date. In the event of withdrawal between the 14th and the 7th day before the filming date, the customer will be charged 50% of the expenses listed in the offer. In the case of withdrawal within 7 days before the start of filming, the full amount specified in the offer is due.
18. Final Provisions:
These General Terms and Conditions apply to all contracts and agreements between Pixeneering and its customers, unless otherwise agreed in writing. Compliance with these terms and conditions is crucial for both parties.
